Privacy Policy

Hi there! If you're looking for information on how we process your personal data and how we protect your privacy here at I Kick Shins, you've come to the right place!

Information we collect

In operating our store, it is essential for us to capture some information about your device, such as your IP address and information related to your visit when you browse our store. For example, this might include time-stamp, the last page or product you visited, or an indication that you logged in.

We do that in order to:

  • remember who you are after you log in so that you do not need to authenticate at each click;
  • monitor if our website is running with the high performance we are dedicated to providing;
  • let you browse between products without having to start back from the home page at each click;
  • remember if you put something in your shopping cart before you decide to checkout; and
  • control that your data is processed securely.

We call the information mentioned above “essential information,” and we collect it through the use of cookies. Cookies are small text files that most websites use. A website places cookies in the web browser and then reads the information collected through the cookies every time the user performs an action. We use cookies. Without enabling this mechanism and this kind of cookie (first-party cookies), we could not provide you with the smooth experience that you expect while navigating.

We also use some specific information related to your visit, such as the timestamp of your visit, the page or the product you viewed, where you are coming from (like if you came to our store because you clicked on an advertisement or you just opened our direct link). This is very similar to the “essential information,” but we use it to provide you with a personalized experience. The information on your visit provides us with insights on your interests and allows us to send you relevant communications. We capture this information through cookies, called a "beacon," that we allow you to block.  Please refer to the "How to accept or reject cookies" section further down the page for details on how to block cookies.

Order information you expressly provide

If you buy something from our store, we will need more specific information about you. To fully process your order and ship the merchandise you selected, we need your personal data such as your first and last name, your email address, your shipping address, and your billing address. We also use your contact and order information to send you communication related to the processing of your order. We will ask you to provide this information in our “checkout page” before letting you finalize your purchase with the payment.

Accounts

You can sign up for an account if you’d like, although it's not required. Creating an account will allow us to remember your information so that, when you decide to buy our products, you will not have to provide all of your information over again -- you just have to log-in. Before registering your account, we will ask you to expressly provide your consent to this privacy policy. We will only open your account if you give that consent.

You can withdraw your consent at any time; just contact us and we'll delete your account within one business day.

How do I withdraw my consent?

If you change your mind after you opt-in, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at ikickshins@gmail.com or mailing us at:

I Kick Shins
690 Roberts Rd #383

We will delete your account within one business day of receiving your request.

How to accept or reject cookies

You are welcome to block the use of some or all of the cookies we use on our website. However, please be aware that doing so may impair our website and its functionality or may even render some or all of it unusable.

You should also be aware that clearing all cookies from your browser will also delete any cookies that are storing your preferences, for example, whether you have accepted cookies on a website, or any cookies that are blocking other cookies.

You can find more detailed information about cookies and adjusting your browser settings by visiting www.allaboutcookies.org

Disclosure

We may disclose your personal information if we are required by law to do so, if you attempt to use a stolen credit card, debit card, Amazon account, Paypal account, or other unlawful electronic payment during checkout, or if you violate our Terms of Service.

Bigcommerce

Our store is hosted by Bigcommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

BigCommerce is based in the US and is a participant in the EU-US Privacy Shield Framework and committed to providing best-in-class service and data protection. You can check their participation in the Privacy Shield here on the official site of The International Trade Administration (ITA), U.S. Department of Commerce.

Third-party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can better understand the manner in which your personal information will be handled by these providers. The third party payment gateways that we use are:

All payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We also share your shipping-related data (shipping address, e-mail, and phone number) with Stamps.com in order to print postage for your order. You can find Stamps.com's privacy policy here.

Please remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by our Privacy Policy.

Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Data Retention

We keep your data for as long as you have an account with us. We also keep some data for security investigation. Most importantly, we have specific obligations for fraud detection and tax reasons. Therefore, we might need to retain certain data even if you ask to delete it. We only retain data that is required for tax purposes and fraud detection.  We keep offline records for tax purposes for 7 fiscal years after the year that an order was placed.

Changes to this Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
